R (British American Tobacco and others) v Secretary of State for Health [2016] EWCA Civ 1182

The Court of Appeal (Lewison LJ, Beatson LJ, Sir Stephen Richards) handed down on 30 November 2016 a 94 page judgment and confirmed the earlier finding of the High Court that the Standardised Packaging of Tobacco Products Regulations 2015 are lawful. The general aim of these Regulations is to introduce plain packaging of cigarettes and, in substantial measure, to restrict the branding previously permitted on tobacco packaging.

Professor Dan Sarooshi acted as part of the team of Counsel representing British American Tobacco in the Court of Appeal. He was instructed in the case by Philip Pfeffer and Andrew Lidbetter of Herbert Smith Freehills.
