Jahangiri v St George’s NHS Trust

On Tuesday 28th August 2018, Mr Justice Nicklin granted an application for an injunction brought by senior heart surgeon Professor Marjan Jahangiri, who was previously excluded from her duties at St George’s Hospital in South London. She was excluded having attempted to speak to a colleague about a disciplinary action which was unrelated to an ongoing investigation into the Cardiac Unit at the Hospital.

Following this exclusion, injunction proceedings were brought for an order to reinstate her.  The Trust subsequently issued another letter which stated that Professor Jahangiri was excluded from the Trust for a second time on different grounds.

Mr Justice Nicklin held that there were strong grounds that both exclusions of the Claimant were in breach of contract, and that the severe damage to her reputation and to patient safety were overwhelmingly in favour of granting the injunction. The Judge ordered the Trust to reinstate Professor Jahangiri to her full clinical, teaching and research duties with immediate effect.
