ICSID Tribunal Dismisses Group Investor Claim Against Romania

27 January, 2025

On 16 January 2025, an ICSID tribunal dismissed a group claim against Romania brought by 44 European and Asian solar investors under the Energy Charter Treaty (Fin. Doc S.r.l and others v Romania ICSID Case No Arb/20/35).  In its final award the Tribunal dismissed all the claim on the merits, finding that Romania’s changes to its renewable energy support scheme in 2014 did not breach the ECT.

Details about the case can be found on the ICSID website.

Tariq Baloch acted for Romania, together with co-counsel Jean-Paul Dechamps from Dechamps International Law and his team (Gustavo Topalian (partner), Pablo Jaroslavsky (counsel), and associates  Julieta Cappelletti, Ignacio Wernicke and Mercedes Lovaglio Rivas); Jonathan Gass (independent); Andrei Pelinari (Pelinari & Pelinari); and Alexandru Stanescu (Lexters).
