This session will look at the specific particular issues that arise in relation to arbitrations involving States and State entities, focusing in particular on the latest developments in the field of enforcement. Drawing on their experience of hard-fought enforcement battles in the English courts, the panellists will cover issues including:

  1. Procedural issues: serving arbitration claims on States; whether injunctive relief can be awarded and enforced against States; the ability of a State to challenge an arbitral award and whether that automatically entails submission to the jurisdiction.
  2. Immunity and the registration and enforcement of awards: the recent conflict of authority in England.
  3. State assets: when the assets of a State entity can be used to satisfy an award against the State; when assets of the State will and won’t benefit from immunity; and innovative approaches by award creditors to the identification of potential assets for enforcement.
