The Supreme Court decision in UniCredit Bank GmbH v. RusChemAlliance LLC has been named the “Most Important Decision” of the last year at the Global Arbitration Review (GAR) Awards, held during Paris Arbitration Week 2025.
The decision of the Supreme Court was published last September, following an expedited hearing and decision on such appeal six months earlier in April 2024. Amongst other things, the case establishes the parameters of the English Court’s jurisdiction to grant anti-suit injunctive relief to enforce an arbitration agreement specifying a foreign seat. A summary of the judgment can be found here.
This is the second year in a row in which members of chambers have acted in GAR’s “Most Important Decision” (see here).
Stephen Houseman KC and Stuart Cribb represented UniCredit as anti-suit claimant and respondent to the jurisdictional appeal (together with Professor Jonathan Harris KC (Hon) of Serle Court for the Supreme Court), instructed by Latham & Watkins LLP.
